DOL Proposed Rule Addresses Independent Contractor Status
The U.S. Department of Labor (DOL) Wage and Hour Division is accepting public comment on a proposed rule designed to help clarify when a worker is an employee under the Fair Labor Standards Act (FLSA) and when they may be properly classified as an independent contractor.
The proposed rule would rescind the 2024 rule addressing the classification of independent contractors and replace it with an analysis intended to provide greater clarity and predictability regarding proper classification.
