Resources Updated: FML for Birth or Placement of a Child
HR Services resources related to family and medical leave (FML) have been updated.
Frequently Asked Questions-Family and Medical Leave Benefits for Birth or Placement of a Child, available in the HR Services Resource Library (member login required), is a useful resource for understanding the requirements to provide eligible employees with up to 12 weeks of leave related to birth, care of a newborn, and placement for adoption or foster care.
The FAQ has been updated to include a requirement from House Bill (HB 2) of the 89th Texas Regular Legislative Session which allows a classroom teacher to elect not to use paid leave when taking FML for pregnancy or birth or adoption of a child. The exception, added as Texas Education Code (TEC) § 21.418, applies even when a school district requires concurrent use of paid leave with other FML-qualifying events.
The HR Services Resource Library topic Family and Medical Leave and the Sample Absence from Duty Report have also been updated to reflect this new provision.
The HR Services Resource Library includes several other resources related to FML, including certification forms, eligibility and designation notices, and a process flowchart. To find these resources, log in to tasb.org, select the HR Services Resource Library from the Resources dropdown menu, then search for “FMLA” in the library search bar.
