Can an organization require an employee to obtain a medical examination?
Yes. Policy DBB(LEGAL) states that an organization may require an employee to obtain a medical examination that is job-related and based on business necessity. In other words, if an employer suspects that an impairment is affecting an employee’s ability to perform the essential functions of their job, requiring a medical examination is an appropriate response.
The employee may be placed on leave to visit their doctor and obtain the medical examination and remain on leave pending the results. If the organization chooses to designate the physician for the evaluation, they must pay the associated fee.
Should the results of the examination determine that the employee has a physical or mental impairment that impedes the employee’s ability to perform the essential functions of their job, the next steps should follow local leave policy or the Americans with Disabilities (ADA) interactive accommodation process.
