FLSA Reminders: Hiring Young Workers
The U.S. Wage and Hour Division (WHD) recently shared reminders about common child labor law violations.
Summer is a popular time for many businesses, including school districts and colleges, to employ seasonal staff — often teens.
According to the article, the most common child labor violations include:
- Scheduling youth for longer shifts or a later shift than allowed
- Driving a motor vehicle when not permitted
- Use of power-driven machinery
- Performing hazardous work

As a reminder, statute requires all employees to be fingerprinted regardless of age. However, the Texas Education Agency's (TEA) general guidance is that it's a local decision whether or not to fingerprint a current student who is an employee. Districts are encouraged to consult with legal counsel before making that decision.
