Employment Authorization During Government Shutdown

Due to the federal government shutdown, U.S. Citizenship and Immigration Services (USCIS) announced that E-Verify has been suspended as of October 1, 2025.

While E-Verify is offline, employers will no longer be able to enroll in the system, initiate new cases, manage or receive updates, or access technical support.

Despite the suspension of E-Verify, the responsibility to complete Form I-9 in the appropriate timeframe is unchanged. The I-9 compliance requirements still apply.

Until further guidance is issued from USCIS:

  • The “three-day rule” for E-Verify case creation is suspended.
  • Those attempting to resolve a Tentative Nonconfirmation (TNC) will be granted additional time.
