Clarification: Pre-employment or Pre-Service Affidavit

The Texas Education Agency (TEA) provides clarification regarding which individuals are required to complete a pre-employment or pre-service affidavit according to Texas Education Code (TEC) § 22A.055.

In response to numerous inquiries from school systems regarding the implementation of Senate Bill (SB) 571, TEA issued guidance stating that, for purposes of administering TEC § 22A.055, the affidavit must be completed by:

  • Individuals applying for employment; and
  • Service providers whose duties involve direct contact or interaction with students.

The affidavit is not required for service providers whose duties do not involve direct contact or involvement with students. TEA encourages school systems to consult with legal counsel regarding compliance and any related legal obligations.
