Emergency Delegation of Authority to Superintendent

TASB Legal Services provides guidance to school boards requesting that emergency powers be delegated from the school board to the superintendent.

Generally, most superintendents currently have adequate authority to operate during a crisis. For that reason, a sample resolution delegating comprehensive emergency powers to the superintendent will not be offered.  Instead, school boards are advised to work with their district’s attorney to assess needs and utilize single-issue resolutions.

For full details, read TASB Legal’s Emergency Delegation of Authority to Superintendent. The memo includes a Resolution of the Board Regarding Delegation to Superintendent for Waivers, available here in an editable  format.
