Q: Are we required to post a job vacancy before we can rehire an employee who was terminated in a reduction in force (RIF)?
A: Yes. If an employee has actually been separated from employment with the district and the vacancy is a position that requires a certificate or license, it must be posted internally for 10 school days before you can rehire the terminated employee (TEC 11.1513(d)). Vacancies should be posted as quickly as possible to avoid hiring delays.
Each current district employee must be given a reasonable opportunity to apply for the vacancy. The only circumstance in which a teacher vacancy can be filled in less than 10 days is if it occurs during the school year. Notice of vacancies may be posted on a bulletin board in the central and campus offices or on the district’s Web site. The posting requirement does not apply when a district employee is being reassigned to a different position unless the new position requires the district and the employee to sign a new contract.
